Evans Will Change His Plea To Not Guilty At Next Court Sitting, Says Lawyer

Image result for Chukwudumeme Onwuamadike
The Attorney to suspected kidnap kingpin, Chukwudumeme Onwuamadike, alias Evans, Mr. Olukoya Ogungbeje, has claimed that the police forced  his client into pleading guilty to the kidnap charges levelled against him before a Lagos State High Court in Ikeja on Wednesday.
According to a statement bearing the letter head of his law firm, Lawflex Chambers issued after the day’s proceedings in court, Ogungbeje alleged that the police threatened to kill Evans, if he failed to plead guilty, asserting that his client would change his plea to “not guilty” at the next court sitting.
While describing the guilty plea as police-motivated and not out of free will, the lawyer insisted that the defendant was hoodwinked and coerced to plead guilty having spent weeks in detention.
He stated that since June 10, 2017, when the suspect was remanded, the police had not allowed family members and lawyers to have access to him in custody.
Ogungbeje stated that the guilty plea of the defendant on Wednesday was of no effect as his client was not given an opportunity to be guided by lawyers before the charges were read to Evans and other suspects.
He added that the suspect was only served with the charges in the open court on Wednesday and the judge also turned down the plea for an adjournment to afford his client time and facilities as guaranteed by the Constitution to confer with the defendant.
The statement reads, “The information/charge sheet was served on us in open court hence, the need to confer with our client to enable us avail ourselves with the constitutional right of adequate time and facility to put up our defence.
“The court after turning down our plea for adjournment immediately ordered that the counts charges be read to him and others despite our plea for adjournment to enable us confer with our client in accordance with the law.
“After the purported guilty plea of our client and the court rose, we stressed to have brief discussion time with our client and he told us clearly that the police told him to plead guilty failure to which they would kill him.
“This is definitely unconstitutional and we intend to challenge this unconstitutional procedure for hoodwinking, undue influence, brainwashing and coercion on an accused into entering a guilty plea against his wish and free will.
“He pointedly told us that being informed us that being informed now, he will change his police-motivated guilty plea to not guilty at the next adjourned date.
“It is settled Law that plea of guilty must be made voluntary and direct devoid of any influence, coercion and manipulation.
“In the meantime, after our brief conferring with our client in open court, he made it known to us that he will change his police motivated guilty plea to ‘not guilty’ at the next adjourned date.”
Ogungbeje pointed out that he, as defence lawyer, has “a responsibility to assist the cause of justice in accordance with the law”.
“This press statement is necessary for the Public to be well informed and proper education of the Evans’ case,” he stated.
Insinating that his client was prone to police manipulation, the lawyer said, “It must be noted that Our Client had been in Police Custody since 10th of June 2017 till date and we his lawyer and family members have been denied access to him”.

Sirika, while speaking at the 2017 15th edition of the National Council on Transportation (NCT) taking place in Sokoto State, said there was need for every sector to operate efficiently for the recovery of the nation's economy.

"This has become urgent for us given the fallen price of oil which had been our main stay and the resultant decline in government revenue," he said.

According to the minister, "Transportation is the wheels that roll the economic development of countries. The sector contributes to the economic sectors which include oil and gas, tourism, travel, agriculture, trade and commerce, manufacturing and other non-oil sectors.

"Nigeria is the largest economy in Africa with a population of over 180 million people. Presently, the country has 27 functional airports and several privately owned airstrips and helipads. "Also, according to the International Air Transport Association (IATA), air transport in Nigeria supports more than 650,800 jobs including tourism-related employment, while contributing US$8.2 billion to the country's GDP annually."

He noted that the statistics underscored the importance of aviation in the economy of Nigeria but, "in relation to our population size and geographical location, the country has the potential to do more."

Sirika hinted that currently, there is no effective inter-modality of air transportation with other modes in terms of infrastructural linkages except road network. "However, construction works are at advanced stage to connect the Nnamdi Azikiwe International Airport to rail while the master plans of the other international airports have provision for linkages.

The minister, who was represented by the Permanent Secretary, Ministry of Transportation and Aviation, Sabiu Zakari, further said in preparation for an efficient inter-modal transport system, "President Muhammadu Buhari has approved a robust road-map for the aviation sub-sector, and that the road-map intends to address some of the infrastructural gaps and challenges with a view to providing long-term solutions.
