Court Remands Lady for Defiling Minor in Edo

A Magistrate Court in Evboriaria, Benin-city, Edo State on Monday remanded a 43-year-old lady for allegedly defiling a minor.



The lady, Miss Esther Ehikhioya, was remanded on one-count charge for allegedly defiling a two-year-old girl.



The suspect was said to have on February 3, 2020, inside the premises of the Catholic Intercessory Academy located on Sapele Road in Benin-city, defiled the minor.



Until the incident, Miss Ehikhioya was said to be a nanny to her unsuspecting victim.


According to a charge sheet in the suit No: MEV/61C/C/2020, Miss Ehikhioya had unlawfully and indecently assaulted the little girl by allegedly inserting her finger into the minor’s private part.



It was gathered that the action of the lady led to breaking of the little girl's hymen.



The offence, according to the charge, is contrary to the law, and punishable under section 360 of the Criminal Code Cap 48: Vol. 11, Laws of the Defunct Bendel State of Nigeria 1976 as applicable in Edo State.



The charge read: "That you Esther Ehikhioya (female) on the same date, time and place in the aforementioned magisterial district did unlawfully had carnal knowledge of a girl, 2, without her consent or even with the consent which is immaterial as to her age, and thereby committed an offence under section 218 of the Criminal code Cap 48: Vol 11 Laws of the Defunct Bendel State of Nigeria 1976 as applicable to Edo State."



Also, police medical report on the incident dated February 3, 2020, with reference number CH: 8820/EDS/PMS/O/VOL. 1/68 and conducted before the presence of the father, mother and aunty of the minor on February 4, 2020, at about 1400hours revealed that the hymen of the minor in pre-school was not intact, no abrasion and nil bruises.



Magistrate Dorothy Adamaigbo, however, adjourned the case to March 26 for hearing.
