Judge Orders Court Bailiff To Serve Summons To Jonathan In 5 Days As He Fails To Appear In Court

Justice Okon Abang of the Federal High Court, Abuja, has directed the court bailiff to summon former President, Dr. Goodluck Jonathan, to the court within five days.
The directive was issued on Wednesday after Jonathan failed to appear in court earlier in the day to testify as a witness in defence of a former National Publicity Secretary of the Peoples Democratic Party (PDP), Chief Olisa Metuh.
Metuh’s legal team, led by Dr. Onyechi Ikpeazu (SAN), filed the draft subpoena before Justice Okon Abang shortly after the Monday’s proceedings having revealed that he would seek to subpoena the ex-President as a witness.
Ikpeazu told Justice Abang during Monday’s proceedings that he had written formally to the former President notifying him of his intention to have him testify in court but that the former President did not reply to his letter.
The former President, however, failed to appear in court, prompting the trial judge to issue the summon.
Similarly, Justice Abang also ordered the Prosecution to persuade the Department of State Services (DSS) to produce detained former National Security Adviser (NSA), retired Col. Sambo Dasuki in court on October 31 to testify in Metuh’s trial having struck out an application by Dasuki seeking an order setting aside the subpoena directing him to appear in court to testify as a witness in defence of Metuh.
Justice Abang ruled that having been ordered by the Court of Appeal in Abuja on September 29, 2017, he lacked jurisdiction to hear and determine the motion on merit insisting that determining the motion on merit would amount to an attempt to review the judgment of the higher court leading to “judicial anarchy”.
“If the applicant(Dasuki) is dissatisfied, he should know what to do and where to go, but certainly not this court,” the trial judge ruled.
Metuh and his company, Destra Investments Ltd, are facing a seven-count charge since January 2016, for allegedly receiving the sum of N400m from Dasuki.
Justice Abang eventuality adjourned the case to October 31, 2017, to enable the summoned witnesses to appear in court to testify in the trial.
