Court Fines Delta Govt N200m for Demolition of Giddy's Place


A High Court sitting in Ughelli, Delta State, has awarded the sum of N200 million against the  state government over the demolition of a recreational centre in Asaba, Giddy's Place, more than four years ago. 

The court said that the demolition was hastily carried out and without any court order so authorizing.

The court presided over by Justice Michael Obi declared the November 15, 2011, demolition of Giddy's Place by the state government in Asaba as illegal, null and void and subsequently awarded a N200 million exemplary damage against the government. 

Moreover, the court ordered the government of Delta State to, with seven days, unseal the premises of the entertainment resort, which had remained sealed since 2011.  

The state government's agents at the time led by commissioners for the environment, information, special duty and works, lands and survey, Frank Omare, Chike Ogeah, Tony Nwaka and Festus Ferife, respectively, had on November 15 2011, supervised the demolition of the popular entertainment resort in the compound before sealing up the place. 

The state government had explained that the demolition of structures at the affected premises became inevitable as they were illegally erected in a residential area without permit.

However, the presiding judge chided the government for what he described as resort to  "self help" in an attempt to get the owners of the entertainment resort to comply with the provision of the law especially when the time given to the management of Giddy's Place to correct the defects had not expired.
